Welcome to the cave.

Some people have Keaton cars, but they usually keep it low key because of WB. I doubt anyone will post pics.
Next month the patent is up and I believe there will more cars shown and at least 2 people I heard of that will offer them as both a kit and fully built.

I know Justin has his own Batmobile Website, but Like they said, everyone keeps it low key because of the Patent. Will it be renewed? Doesn't look like they will.. Could they? Sure they just released some Hotwheels batmobiles, which would prove they are still using it. Do a search on yahoo, Im not on my computer but it should be [sign in to see URL] Ill post later if you cant find it. Anyways like you said we are all fans here, and I personally cant wait to make a batmobile

I don't think the patent will be renewed, but I'm no legal expert. Supposedly, early Nov. it's done.
There is in fact a red 1:25 model Keaton-mobile that was done by my friend Tony. :wink

As for selling batsuits, there are no sales of unlicensed bat stuff on the board. Members may have parts from their collection they're willing to part with and trade from time to time, but all of this is handled off the board.
Get to know some people and hang around for a while and see how things work, and you could be on your way to making your very own Batsuit.
When you get a minute, please go over the Terms of Service(rules) for a better understanding of the crap I just spewed out. :wink

That car was NOT screen used in any film.
It was built by Jay Orberg. You could not have it in public or be seen in public with it,plus a whole laundry list of dos and don'ts associated with it. Bottom line,it's their car and not your's,even though you paid for it.
There are people on here that know much more than myself, but that's the basics.
It's possible that's the car David Copperfield won in an auction, along with a supposedly screen used full '89 Batsuit.
I think he sued over that, but I'm not sure of the outcome.

There was an auction by i believe Kraus that had 2 or 3 of the 89/Returns cars around april. they said WB had to pre-approve the bidders and anyone the won had to comply with WB's terms before the car would be delivered. I think it consisted of haveing to put it in so many car shows per year. or something to that effect. I think I still have the magazine the ad was in Ill see if I can dig it up. The starting bid i think was 75K. I tell you if i spent 75K on a car I don't care if what WB had to say I would set that SOM BEEOTCH! in my front yard and be seen with it. after all "It's the car, chicks dig the car"

Re: batmobile replica questions

First off the WB contract is all-inclusive, If you violate any portion of the contract WB has the right to take back the vehicle and you get nothing in return. You also must maintain a one million-dollar insurance policy on the vehicle naming them as the beneficiary, so if any thing happens to the vehicle they are reimbursed and not you.

As for the patent, the term of the patent shall be generally 20 years from the date on which the application for the patent was filed in the United States. All the Batmobiles were given 14 years. After the patent has expired anyone may make, use, offer for sale, or sell or import the invention without permission of the patentee, provided that matter covered by other unexpired patents is not used. The terms may be extended for certain pharmaceuticals and for certain circumstances as provided by law. Under certain circumstances, patent term extensions or adjustments may be available.

Check around many museums have several of these cars. Most were built by Jay and sold to them by Barris. One or two a year find a way up on the auction block, the last two I have seen sold for over one hundred thousand dollars. All the museum cars I have seen have all claimed to be screen used and numbered cars, which is untrue.

That really sux that you can buy the batmobile but not fully own it.

That reminds me of an old episode of the Drew Carrey show. Basically Drew won the batmobile only to have it taken away because he was making out with some lady in it. I thought those rules were a [sign in to see URL] not :geez

Even if the patent expires and kits are available, it will still be a huge out of pocket expense to get one. I mean look how much the 60's batmobile kits go for.

It's just nice to know that if you have the money it would be attainable.

The 89 kit is actually much cheaper to purchase than the 66 kit. The build up is much more extensive that the 66, as many of the owners have found out first hand. The biggest problem is the lack of a build up manual. If you have access to one of Jay's cars, his are as close as it comes and he used many of the original aircraft components on the exterior of the vehicle. He did take liberties in the cockpit, which is understandable. I would have done the same.

PS: the patent on the 89 is non-renewable as is all the Batmobiles!

I would think they would be the same. You have the same amount of labor involved in dissassembling the host vehicle, and attaching the fiberglass body, running new wiring, and painting.

As I understand, a turnket '66 would be around $70,000. not chump change, by any means, but obtainable. I would think an '89 would be in the same neighborhood.

That asside, how stable would an '89 be to drive on the open road? Would it need to be scaled down? inqiring minds want to know...

I have been told that Jay Orberg has not done a car in a long time, and that the ones WB sells are done by a friend of Mark Towle's. Not sure if that's accurate or not, but I've heard it from a fairly reliable source.

Anyone know any info about this?

As I understand it,Orberg is not allowed to have anything to do with them because he was making and selling copies and got caught.
I know at least one of the two REAL cars is still in WB's vault. That info came from Dave who went there to study it for the 1:18 Mattel [sign in to see URL] also got to play with the screen used folding '89 Batarang while he was there. emoticon
The other real car is said to be owned by Kevin Whats-his-face(ninja turles creator).
Dunno though.

Yes Jay hasn't built a car in several years, he built most of the cars floating around out there, until WB stopped him and his contract was terminated. His cars are built in a way to be easily identified by the others. There were a few built by Bob Butts, they are very scarce.
The car you speak of was one of the promo cars, WB still owns the two screen used vehicles. I don't see WB releasing them to the general public any time in the future.

Guys, I've got to chime in here on this one. As the author of 8 patents currently on file in the US patent office, I must point out that you're kind of confusing patent law with trademark, copyright and trademark infringement law.

While the patent on the batmobile design may be about to expire, that does NOT in ANY way mean that Warner Brothers no longer holds copyright and trademark rights on their designs.

Only reason I am CERTAIN of this is because this has been discussed before. I'm going to forward this thread to a good pal of mine who also happens to be a lawyer. Maybe he'll be able to shed some light on this with the weight of professional authority behind him.

Re: batmobile replica questions

I agree with matt. I would think that as long as they hold the ownership of the character that implies everything related for as long as they own the character. But if they sell the character to some other corp., then that corp. has the same rights.
In regards to some things Kevin pointed out, I have noticed some definate differences between almost every 89 car I have ever seen in auctions etc.. One thing I notice consistanly is the windsheild. Take a close look at the windshield in the scene where batman and vale hop out after stopping for a road block. Freeze the frame. Notice the windshield is curved from top to bottom. Not so on any other 89 car "I" have seen (not that I have seen every one). Also many of the outside techno stuff is slightly different on almost every car. I'm guessing it's cause they "refurbished the 89 car for the 92' movie. Thus the original 89 car no longer exists per se'. Kinda like if you took the 89 suit, cleaned up all the gnarley detail that gave it so much character - it's sorta not the same suit anymore.
I used to work for six flags, and I know a lot of the cars came from molds that had to be "drafted" i.e. clay used to fill in areas in the mold to insure the part would come out of a hard mold easily. The hood came off easily by itself. The sides and the area behind the canopy were a pain. as were the 6 vents by the side of the air scoop. So, in some sense all these cars are sort of "replicas". Also according to some written descriptions the original 89' car had been painted with 6 different colors to give it that sort of flip flop thing. Anyone ever seen ANY of the 89' cars painted like that? I haven't. Just plain black. Anyone know exactly what those colors were? Also I noticed that alot of the enteriors are different from car to car. One thing that I always notice is the three stick shifts in the middle. Each car that has an interior seems to be slighty different.
Also the stories I have heard about the car vary over the years. I think that I may have seen the actual 89 car back in 90' at a car show. They pointed out that there were 16 cars made. Then quotes from John Evans(car creator) he said there were only 2.
Probaly no one who owns any of these cars cares that much about the details anyway. Has to be THE most recasted car on the planet.

I agree that when the patent is lifted, they still own "The Batmobile",but not neccesarily this design. It's the design of this car that's has a patent and not the name. WB will always own the name.
In other words, you're now free to copy and drive this car(provided it's street legal of course),but it cannot be called the Batmobile.

If you were a person who builds and sells them, you could do it legally, but you just can't call it the Batmobile.
If you were to show it somewhere,it would have to be listed under a different name and no money could be made from it. That's when the problems [sign in to see URL].

So I think after the patent is lifted, you're free to build, buy and sell them, but must still follow certain parameters within the law.

I could be wrong, but this is the way I understand it.
